Felani Mndebele triumph in arbitration case against GMM

Felani Mndebele finally wins R1,7m compensation in arbitration case regarding unfair dismissal case against GMM

In a judgement given by Arbitration Commissioner Freddy Baloyi, it became clear that the ratepayers will once again pay for mistakes made by the ANC majority in GMM Council.

Baloyi awarded Mndebele R1,7m compensation in a CCMA Arbitration ruling made on 29 September 2022.

The embattled Ex-Municipal Manager of Govan Mbeki Municipality took the municipality to the CCMA in an unfair dismissal dispute related to misconduct as described in section 191(5) (a) of the Labour Relations Act No.66 of 1995 as amended (the LRA).

The Municipality has shown disregard for several rulings in this case and the residents will have to foot the bill. The legal fees alone would be a substantial amount. These decisions made by the council of GMM are paid for with money received from levying rates and taxes. Rates and taxes are paid by residents and businesses within Govan Mbeki Municipality.

The Bulletin reported the progress of the dismissal over several articles. These will be recapped shortly.

Baloyi made several references to unfair practices by GMM.

It would be fair to note a few.

“It is common cause and noted in the pre-arbitration minutes that the respondent (GMM) has conceded that no procedure was followed before the applicant was dismissed.”

This means that in layman’s terms, Mndebele’s contract was terminated, but none of the described procedures was followed as required by law.

“It is uncontested that the applicant was dismissed after Council made a resolution to terminate his contract on 16th July 2022. The letter did not stipulate the reasons for the termination except that the item about the termination of his employment contract, namely CA011/07/2021, was discussed and dismissal be effected on 16th July 2021.”

The opposition parties contested the decision but the ANC used their majority to push the item through. In an article titled “Municipal Manager sacked by GMM (July 17, 2021),” the Bulletin highlighted the following:

  • In a council meeting that was described by Cllr James Masango as a Cangaroo Court to fire the Municipal Manager, the ANC voted as per their party caucus decisions leaving the Municipality open for further lawsuits and expenses.
  • In the discussion of the item, Executive Mayor Cllr Zuma acknowledged the fact that Felani obtained a court order against the Municipality compelling them to allow the MM to return to work and halt all proceedings against him.
  • In the judgement by Acting High Court Judge, AJ Brauckmann costs were awarded against GMM. This was after the team from GMM tried to mislead the High Court regarding the Council resolution taken by the council regarding the appeal.

“The following was the order made by the Middelburg High Court: 11.1 the disciplinary proceedings instituted against the Applicant on 16 October 2020 in terms of the Local Government: Disciplinary Regulations for Senior Managers 2010 (“the 2010 Regulations”) is declared unlawful, null and void.”

“The applicant’s (Felani Mndebele) dismissal is on a balance of probabilities procedurally unfair.”

“The reasons given by the respondent (GMM) after the termination of his employment do not amount to charges but mere allegations as they were not tested in a disciplinary hearing.”

“The respondent chose to arbitrarily terminate the applicant’s contract through a process in conflict with the court’s order”

The following award was made:

The dismissal of the applicant (Simon Felani Mndebele) by the respondent (Govan Mbeki Local Municipality) is procedurally and substantively unfair.

The respondent ordered to pay the applicant (Simon Felani Mndebele) the amount of R1 672 257.36 (One million six hundred and seventy-two thousand two hundred and fifty-seven rands thirty-six cents only) into his bank account by no later than 31st October 2022.

GMM Mayor misleads council to obtain condemnation for actions already taken while this will cost the municipality thousands.

The council convened on the 30th of March and the item was presented to the council. In this item, the Mayor, Cllr Nhlakanipho G Zuma, explained the court action that the Municipal Manager took to try and have him reinstated at the council.

This is an important fact on the timeline. The opposition parties vehemently opposed the possibility of an appeal. Unfortunately, the ANC majority decided to go ahead with this appeal.

The problem lies in the fact that the appeal had already been lodged at the high court on the 29th of March, without council approval.

“It doesn’t matter what the opposition says, we will push it through!” The words of MMC Ethel Nkosi still ring in the ears of the opposition as the ANC pushes through their agenda of removing the Municipal Manager.

The last extraordinary council meeting was no different. Opposition parties vehemently opposed the suspension of the Municipal Manager, proposing that at the very least the Mayor and CFO should also be suspended and investigated.

During the presentation of the item, the Mayor, Cllr Thandiwe Ngxonono, accused the Municipal Manager, Felani Mndebele of the late submission of the Annual Financial Statements.

Freedom Front Plus Councillor Aranda Nel-Buitendag said in a statement to The Bulletin: “The FF plus feel the suspension of the Municipal Manager is unacceptable. The allegation that was made by the Executive Mayor of the MM is absurd.”

The ANC majority in council today voted to appeal the High Court ruling interdicting any proceedings against the Municipal Manager

The judgement of the High Court is not painting a rosy picture of the municipality. It would appear as if the ANC in their majority in council will not hesitate to use any means possible to get rid of the MM.

“The DA is of the opinion that the incurrence of exorbitant legal fees on the part of the municipality to fight battles in the high court intended to protect ANC cadres, and the double payment of acting officials and suspended officials is a further wastage of public funds that the bankrupt Govan Mbeki Municipality simply cannot afford – and could have been put to better use if it was allocated towards delivering much-needed services that residents and businesses have been stepping up to the task for at their cost,“ said Councillor Jordaan before the council meeting.

Tourist fatally shot by ruthless criminals on Numbi Road

Nelspruit: 03 October 2022 – Police at Masoyi are investigating a terrible incident in which a tourist was fatally shot by a group of ruthless criminals at Numbi Road near White River in the afternoon of today, Monday 03 October 2022 around 16h30.

According to the report, at that time four tourists from Germany were travelling in a Hyundai H1 on Numbi Road en route to Numbi Gate at Mdluli Safari lodge. They were then stopped by three armed suspects who were driving in a VW Caddy. The suspects are said to have instructed the tourists to open the doors of their vehicle but when the driver reportedly locked all the doors, apparently one of the suspects shot him in the upper body through the window.

It is further said that the victim’s vehicle drove in reverse for about 100 meters before crashing into the wall of Heroes Academy. Unfortunately, the driver died on the spot as a result of the shooting. The suspects reportedly sped off in their vehicle without taking anything from the tourists.

The police at Masoyi as well as other role players in the Emergency Services were alerted about the incident. A murder case was opened with an immediate launch of a manhunt for the suspects.

Meanwhile the Provincial Commissioner of the SAPS in Mpumalanga, Lieutenant General Semakaleng Daphney Manamela has vehemently condemned the terrible atrocity carried out by the suspects. “This is really cruel and uncalled for given the economic challenges that our country is facing. When one has tourists then it means the tourism sector is benefitting in a way which in turn gives a boost to our struggling economy. We call on our good citizens who might have seen or heard anything about these criminals or the VW Caddy they were driving, to come forward and we promise to swiftly act so that they are brought to justice” urged the General.

Sasol appeared in the Secunda Court on 20 September 2022 on environmental charges

Sasol faced environmental charges in a rare turn of events on September 20, 2022. Nomia Machebe, Manager: Media and Communications, represented Sasol at their first appearance in court.

Sasol is facing a variety of charges. They range from pollution to Illegally dismissing a whistleblower to constructing facilities without the necessary authorisation.

“On Wednesday, 27 July 2022, the National Prosecuting Authority served Sasol with a summons instituting criminal proceedings. The charges relate to historical aspects of environmental management at its Secunda Operations,” said Alex Anderson, Group Media Manager: Sasol, In a statement released by Sasol.

“The summons follows an investigation by the National Environmental Management Inspectorate (EMI), as an agency of the Department of Forestry, Fisheries and the Environment (DFFE). Sasol fully cooperated with the authorities in this investigation,” continued Anderson, “The first appearance in the matter was in the Secunda Magistrate’s Court on 20 September 2022. The matter was postponed to 13 January 2023 for further investigation by the State, while Sasol awaits the docket.”

Some of the charges that Sasol is facing are so severe that fines of up to R10m or imprisonment (or both) could be made. This would be for each incident or collective, as decided by the judge.

Section 332 of the Criminal Procedure Act 51 of 1977 provides for the criminal liability of corporate or juristic persons as well as for directors and employees (shortened). In short, those that were involved as well as the directors could be held responsible in terms of the act.

Unauthorised disposal of waste.

Sasol stands accused that, between January 2012 and February 2019, they illegally discharge or negligently disposed of waste that contained Vanadium, Diethanolamine & Potassium Carbonate from the Benfield West unit inside the Sasol plant. This was allegedly done through the chemical drain valve at the Benfield West phase 1 area into the chemical sewer which flowed into the API dams.

Unlawful prejudice and/or dismissal of a whistle-blower.

Whistle-blower Ian Erasmus was allegedly unlawfully dismissed in July 2020. The charges state that Erasmus’s contract of employment was terminated without any reasonable grounds

Disposal that is likely to cause pollution.

Sasol also stands accused that, between January 2012 and February 2019, they unlawfully and negligently, disposed of waste in a manner that was likely to cause pollution or harm to health and well-being, by disposing of Vanadium into the API dams in which water is used in the cooling processes of the facility, and also discharged into the neighbouring river.

Commencing with listed activities without an environmental authorisation. (Activity 8)

Sasol allegedly disposed of waste as defined in section 20 of the Act, excluding domestic waste, but including the establishment, expansion, upgrading or closure of facilities for all waste, ashes and building rubble, by rehabilitating the Black Product Area without an Environmental Authorization and/ or a prescribed permit.

Commencing with a listed activity without an environmental authorisation (Activity 55)

In this charge, Sasol stands accused of allegedly constructing facilities for the treatment of effluent, wastewater or sewage with a daily throughput capacity of more than 2000 cubic meters but less than 15000 cubic meters, by constructing the MSU plant (Desalination Plant) without an environmental authorisation and/ or a prescribed permit/s.

And lastly, Sasol is charged with allegedly channelling the water from the API dams which is likely to contain the chemical Vanadium, into the Klipspruit river, an activity which caused or was likely to cause groundwater and environmental pollution between January 2012 and February 2019

The elemental metal is rarely found in nature, but once isolated artificially, the formation of an oxide layer somewhat stabilizes the free metal against further oxidation

Health Hazards of Vanadium

Vanadium compounds are not regarded as a serious hazard, however, workers exposed to vanadium peroxide dust were found to suffer severe eye, nose and throat irritation. The uptake of vanadium by humans mainly takes place through foodstuffs, such as buckwheat, soya beans, olive oil, sunflower oil, apples and eggs.

Vanadium can have a number of effects on human health when the uptake is too high. When vanadium uptake takes place through the air it can cause bronchitis and pneumonia.

The acute effects of vanadium are irritation of the lungs, throat, eyes and nasal cavities.

Other health effects of vanadium uptake are:

– Cardiac and vascular disease
– Inflammation of the stomach and intestines
– Damage to the nervous system
– Bleeding of livers and kidneys
– Skin rashes
– Severe trembling and paralyses
– Nose bleeds and throat pains
– Weakening
– Sickness and headaches
– Dizziness
– Behavioural changes
The health hazards associated with exposure to vanadium are dependent on its oxidation state. This product contains elemental vanadium. Elemental vanadium could be oxidized to vanadium pentoxide during welding. The pentoxide form is more toxic than the elemental form. Chronic exposure to vanadium pentoxide dust and fumes may cause severe irritation of the eyes, skin, upper respiratory tract, persistent inflammations of the trachea and bronchi, pulmonary oedema, and systemic poisoning. Signs and symptoms of overexposure include; conjunctivitis, nasopharyngitis, cough, laboured breathing, rapid heartbeat, lung changes, chronic bronchitis, skin pallor, greenish-black tongue and an allergic skin rash.

What is Diethanolamine and what are the Health hazards

Diethanolamine is a surfactant, corrosion inhibitor; component in soaps, shampoo, cleaners, polishers, cosmetics, and pharmaceuticals; chemical intermediate in the rubber chemicals industry.

It is listed as Cancer-Causing by the California Environmental Protection Agency’s Office of Environmental Health Hazard Assessment

It also becomes very hazardous when combined with other substances such as nitrates.

What is Potassium carbonate and what are the hazards

Potassium carbonate, K2CO3, appears as a white powder or as a colourless solid crystal and has a salty taste. Also known as potash or pearl ash, it may be used in pharmaceutical laboratories as a drying agent or as a source of potassium. It is also used in fire extinguishers, to make soap, to make glass, and softened water

Potassium carbonate causes severe skin burns and serious eye damage, it also causes serious eye irritation. It may result in permanent eye damage. It is harmful if inhaled or swallowed.

It may be corrosive to metals.

Potassium carbonate is harmful to aquatic life as it may increase the pH of waterways which will adversely affect aquatic life.

Foiled Truck Hijacking, 3 arrested

THREE SUSPECTS ARRESTED AFTER FOILED TRUCK HIJACKING

Nelspruit: 30 September 2022 – Speedy reaction by police resulted in the arrest of three suspects aged between 28 and 45 on Thursday night, 29 September 2022 around 21h00 after their attempted truck hijacking was foiled by another truck driver in Carolina.

It is alleged that one of the suspects alighted from the suspect’s VW Golf and boarded a truck whilst it was in motion and pointed at the truck driver with a firearm.

The truck driver behind realised what was happening, he flashed lights whilst blowing a hooter to distract the alleged hijacker.

The suspect was probably frightened and he alighted from the truck then got back into their VW Golf and fled the scene with the other suspects.

Police were informed about the incident, and they then quickly mobilised and operationalised the information. They (members) were on the lookout for the suspects. The search bore positive results as the vehicle fitting the description of the suspected vehicle was spotted with three suspects around midnight (00h00). One of the occupants was wearing clothes identical to the complainant’s description.

All three suspects believed to be involved in the intercepted hijacking were arrested with the VW Golf confiscated. As the investigation continues, the suspects could also be possibly linked to other previously hijacking incidents committed. The trio is expected to appear at the Carolina Magistrate’s Court as soon as all investigative processes are finalised.

Department of Public Works officials and company directors arrested for corruption

MPUMALANGA – The Department of Public Works officials; Deputy Chief Director, Sipho Ronny Monareng (50); an official, Magdonald Boto Sigudla (43); a State Accountant, Bandile Jacob Ngcebo Official (41) and suppliers; Maganeleng Antony Mashego (43), Whisky Delisa Khumalo (45) as well as Tshidi Suzen Sedibe (43) appeared before the Nelspruit Magistrate’s Court on Wednesday, 28 September 2022 after they were arrested by the Hawks’ Nelspruit based Serious Corruption Investigation on the same day for corruption, fraud and money laundering.

It is alleged that during the Covid-19 pandemic, Monareng colluded with the company directors who made misrepresentations and submitted claims to the Department of Public Works for the services which were never rendered thus prejudiced the department an amount of R1.38 million. The matter was reported to the Hawks in November 2021 for further probe. During further investigation, it was established that Monareng facilitated the whole process. The case was finalised and handed over to the court that issued warrants for their arrests hence their appearance before the court.

The accused were granted R10 000 bail each and the case was postponed to 2 November 2022 for further investigation. More arrests are imminent.

Ten (10) more illegal miners arrested

TEN MORE ILLEGAL MINERS ARRESTED WHILE THE THREE STILL IN CUSTODY  

MPUMALANGA – Tau Moyana (17), Josia Mlambo (18) and Nonhlahla Fortunate Mavuso (38) were remanded in custody by the Matsulu and Barberton Magistrates’ Courts on Tuesday, 27 September 2022 respectively for illegal dealing in gold-bearing materials in terms of the contravention of the National Environmental Management Act.

Their appearance follows their arrest during a multidisciplinary intelligence-driven operation conducted by the Directorate for Priority Crime Investigation in Mpumalanga, Mpumalanga Provincial Detectives, National Intervention Unit (NIU), Department of Home Affairs (DHA), Department of Mineral Resources and Energy (DMRE), Department of Environmental Affairs, Tactical Response Team (TRT), Local Criminal Record Centre (LCRC), K9 Unit, Explosives Unit as well as SSG Security Barberton on Monday, 26 September 2022 in Barberton Borehill-Mjindini, Sheba, Verulum and Matsulu B respectively.

During the operation, numerous pendukas, generators, gold-bearing materials, gold metal detectors, gas cylinders, compressors, iron balls, and containers were confiscated. The estimated value of the seized property is R200 000. Bones suspected to be of endangered species were also confiscated for further investigation.

The case against the ten suspects arrested for illegal mining is rolled to Thursday, 29 September 2022 for a formal court appearance. The suspects remain in custody

Meanwhile, the same team continued with the operation at Slaehoek Waterval Boven on Tuesday, 27 September 2022 where an additional ten (10) suspects were arrested for illegal dealing in gold-bearing materials. The suspects aged between 19 and 56 are expected to appear before the Waterval Boven Magistrates’ Court on Wednesday, 28 September 2022.

During the arrests, generators, explosives, pendukas, gas cylinders, gas bottles, gold-bearing materials, and music sound systems were seized for further investigation. 

The estimated value of the seized property is over R1 million.

Woman arrested with drugs on prison grounds

Woman arrested on Bethal Prison Grounds with substances

Nelspruit: 28 September 2022 – A 36-year-old woman was apprehended by a prison warder for alleged possession of drugs at the Bethal Correctional Centre. The centre is working towards creating a “No-Go area for drugs” and the woman was reportedly caught before entering the premises to visit an inmate yesterday, 27 September 2022.

The female visitor has reportedly been searched as per prison standard procedures when a black plastic bag concealed beneath her underwear was found. It was then discovered that the plastic bag was stuffed with about 59 different types of tablets, as well as 20 small plastic bags and other substances including crushed leaves and a plastic bottle containing oil.

Police were summoned to the scene where the female suspect was arrested and then charged with the illegal possession of drugs. The concealment thereof was confiscated pending a forensic investigation. The estimated street value of the alleged drugs is about R6000. The investigation suggests that the alleged items were destined for an inmate and of which the matter is still under investigation.

The police and prison officials are said to have proceeded to the inmate‘s bed where a search was further conducted. An additional plastic bag containing dagga was found. The inmate is also facing a charge of possession of dagga as well and he will soon appear in court.

However, Ms Lorraine Nomsa Makhubele appeared at the Bethal Magistrate’s Court, today, 28 September 2022 on charges of alleged possession of drugs. Possible charges of drug trafficking might be added as the investigation continues. During her court appearance, the matter was postponed to 05 October 2022 for a formal bail application meanwhile the suspect was remanded in custody.

The Provincial Commissioner of the SAPS in Mpumalanga, Lieutenant General Semakaleng Daphney Manamela has commended officials from the Correctional Facility for their vigilance and for the arrest as well as the recovery of the items.

ANIMALS 101 – HELPING WILD BIRDS IN THE BEST POSSIBLE WAY

COMPASSIONATE PEOPLE ARE CONCERNED WHEN THEY FIND WILD ANIMALS INCLUDING BIRDS BUT ARE OFTEN UNSURE OF HOW TO HANDLE SITUATIONS.

We have had so many people recently contact us with regards to finding a birds in their gardens. Sometimes wild animals end up around our homes and many people with good intentions try to help them.  There is always a possibility that you might do more harm than good if you don’t know how to handle the situation correctly. Today we will focus on finding birds and give some general guidelines shared by the NSPCA and other wildlife rehabilitation organizations.

Sometimes it is a bird/animal that had a stressful encounter and is now just “catching their breath”, other times they might be injured and lost, or is a baby/fledgling. Unless in immediate danger or injured…….let them be.  If it is an adult bird (any animal), they might also have babies nearby, which could die if you remove them.

Don’t BIRDNAP the babies! Many young birds may appear abandoned, but they are probably waiting for mom or learning to fly. The process of fledging begins by jumping out of the nest. It usually takes them 3-4 days to learn how to fly. It is the time when mom teaches them how to fear, forage and fly. We know it is a dangerous world, but this is why it is so crucial to learn these skills from mom. If they look a little scruffy, fully feathered, standing and hopping, they are probably a fledgling.

WHAT TO DO IF YOU FOUND WILDLIFE – IN SHORT

1. If they are injured, take them to the vet as soon as possible.

2. If not injured or in immediate danger, let them be and observe.

3. Before you remove them, first contact a wildlife rehabilitator, local welfare organizations, or SPCA to advise.

4. Do not give food or water before speaking to a rehabilitator…..that is why you should contact them as soon as possible. You could kill them by giving them something that their body can’t handle at that moment. You can’t feed a dehydrated bird and the public might not be equipped to know how to recognize the symptoms and they might have an internal injury. For dehydration, they might need liquid therapy too.

Don’t feed them even if it is a tiny baby. Forced syringe feeding is usually a struggle for humans and birds. They can also aspirate, so please do this with the guidance of a rehabilitator only. Many people have this notion to feed Weetbix or ProNutro, but we strongly advise against it. There are safer options if you have to and the rehabilitator will advise on it.

Remember that stress is a big killer of rescued wildlife!

SOME POSSIBILITIES might include (first confirm with the right people):

  • To let them be while you look for mom nearby.
  • To put the baby back in the nearby nest if you know it is theirs.
  • To take them in and keep them safe until the right person can fetch them.
  • Get the bird to a wildlife rehabilitator as soon as possible – it will be highly beneficial to the rehabilitators if you keep a record of any injuries you may have noticed when you found the bird as well as any information regarding the treatment of the bird whilst in your care for example whether or not you have given liquids, whether they had any bowel movements, strange behaviour and where you found them.

WHAT TO DO WITH WILDLIFE UNTIL PROFESSIONAL HELP ARRIVES

  • Prepare the container. Place newspaper or straw on the bottom of a cardboard box or container with a lid. Don’t use sawdust as it can interfere with respiration.
  • If it doesn’t have air holes, make enough for good ventilation. For smaller birds, you can use a paper sack with air holes.
  • Protect yourself. Wear gloves, if possible. Some birds may stab with their beaks, slice with their talons (claws) and slap with their wings to protect themselves, even if sick; birds might have parasites (fleas, lice, ticks) and carry diseases.
  • Cover the bird with a light sheet or towel.
  • Gently pick up the bird and put it into the prepared container-do not hold the bird across its chest as this can damage the crop and the internal organs of the bird which will kill it. Keep the bird in a container; don’t let it loose in your house or car.
  • The correct manner of holding a bird is as follows:

Place a hand over the top of the bird very gently with your index finger and middle finger parting in a “V”. The neck of the bird should rest between the arches of the “V” as to stabilize its head and neck. With your other hand support the bottom of the bird and allow its feet to rest comfortably in your hand. Secure the wings of the bird. Do not handle the bird with a tight grip as it just needs to be stable in the above position. Handle firm enough so they don’t escape and get injured, but gently enough not to hurt them yourself. Do not handle them unnecessarily.

  • Warm the bird if the weather is cold/wet or if the bird is chilled. Put one end of the container on a heating pad set on low. Alternatively fill a zip-top plastic bag, plastic soft drink bottle with a screw lid, hot water bottle, or rubber glove with hot water; wrap a warm container with a cloth and put it next to the bird. Make sure the container doesn’t leak, or the bird will become wet and chilled.
  • If the bird is soaking wet and only if the rehabilitator advised so, use a hair dryer on low/medium warmth to dry the bird. Very important: Keep one hand between the bird and the hairdryer so you can feel the heat. Make sure you do not burn the bird. Ensure there is not a massive build-up of heat in the box while drying. As soon as their feathers are fluffed and the bird is warm, leave it to cool down to room temperature in a quiet area.
  • Tape the box shut or roll the top of the bag closed. Obviously not the air holes.
  • Keep the bird in a warm, dark, quiet place. Leave the bird alone, don’t bother or handle it. It is stressful for wild animals to be kept in a noisy environment where there are lots of unfamiliar or predator smells and stress is the biggest killer of rescued birds. Keep children and pets away.
  • Again, do not give them food or water.
  • Contact a wildlife rehabilitator, the SPCA, nature conservation department, or wildlife veterinarian as soon as possible.
  • Don’t keep the bird at your home longer than is necessary.
  • It would be prudent to leave the bird in the box undisturbed for the evening if it is found late afternoon, unless you’ve picked up an owl, in which case, release them as soon as it is dry so it can hunt, if not injured. Release the animal where you found it, as early in the morning as possible. They start chirping from 4.30 am in the summer months but 5.30 / 6 am would be fine too. Make sure dogs or cats cannot get to them while they are in the box getting their bearings before taking off.
  • If you did put water in a small accessible container, make sure the water is not bumped over and the bird then goes without water. Again, this is after you confirmed with a rehabilitator.
  • Wash your hands after contact with the bird. Wash anything the bird was in contact with – towel, jacket, blanket, carrier to prevent the spread of diseases and/or parasites to you or your pets.
  • If there have been heavy rains or other extreme weather, please take a few extra minutes and check gardens for wildlife that may be drenched and not able to fly.

What happens to the bird afterward?  Wild birds need to go back to the wild.  If injured, they will need professional help from rehabilitators. It is important to remember that rehabilitators will evaluate each situation individually.  Although the above are general guidelines please ALWAYS contact a rehabilitator first.

BIRD OF PREY

If you found a young bird of prey alone and they appear to not be injured, watch from a distance to see if mom returns. If you can approach the bird, they are likely very sick or seriously injured.  If this is the case, follow the above guidelines and contact the vet or rescue organization.

  • Do NOT use a wire cage/cat cage or something similar.
  • Make note of where the bird was found.
  • Do NOT attempt to feed the bird or provide water.
  • As above, if it is an owl and not injured, release them at night and don’t keep them for the evening.

GEESE

Common to many areas this time of year, the Egyptian goose population is one of the few on the increase. Egyptian geese lead their goslings to water a few days after hatching, often along busy streets.

“Unlike some of our local wildlife whose existence is being severely threatened by human development and urbanization, our ever-expanding cities and suburbs are proving an ideal breeding site for Egyptian geese. In addition to a warm climate, Egyptian geese look for access to a freshwater source and an area with plentiful food. So, be it your swimming pool, an eco-estate or a golf course, our Egyptian geese are currently spoilt for choice when it comes to sites to rear their young,” says CROW director, Paul Hoyte.

Hoyte suggests leaving the geese be, if they take up residence in gardens, except where there is a danger of attacks from pets. In these cases, he appeals to people to assist them with safe capture.

If you find them in the street, DO NOT “rescue” the goslings or any other little ones by separating them from their parents. You can rather escort the family through the traffic to the nearest pond.

“The biggest problem we have is that to give the goslings the best chance of survival, we need to catch mom and dad too. Herein lies the problem, as they simply fly away as soon as we arrive with our catch and throw nets. Thankfully, what we have been finding as a huge help, is if the homeowner is prepared to lend us a helping hand by getting the family into any enclosed area such as a garage or shed before we arrive”.

“This is relatively easy to do with a washing or laundry basket. Gently scoop up each of the goslings and place them in the basket. Then, with mom and dad watching you, take the goslings and place the basket in your open garage or shed. Soon enough, mom and dad will make their way into the room to be close to their babies. As soon as they’re in, close the door and contact your local rescue to come and catch them.”

Remember: Never feed any ducks or geese bread!

WILDLIFE AND THE SPCA

It is important to understand that it is against the law to keep wild mammals/birds if you don’t have permits, even if you plan to release them. The SPCA is a place of safety for animals, dogs and cats being the most commonly handled or admitted animals and no animal is ever turned away. They care for farm and domestic animals. Wildlife is also accepted with indigenous animals being relocated to approved wildlife rehabilitation centers.

Shots fired at ANC Councillor in failed ambush

ANC Councillor was nearly killed when shots were fired at him tonight.

Cllr Simphiwe Sindelo, Ward 4 Councillor was ambushed and shot at his home in eMbalenhle, Ext 25 at around 20H00 tonight.

The councillor had just parked his vehicle at home when the perpetrators started firing shots at him.

He then fled into the house and the perpetrators continued firing shots at the house and the door.

When they attempted to open the door, Cllr Simphiwe Sindelo fought back and fired back.

A total of eight cartridges were found at the side of the car and investigators are searching for the ones at the side of the house and the door.

One (1) of the suspects fled into the bushes.

At the time of the incident, Cllr Sindelo’s family including an infant were in the house.

Forensic Investigators are currently at the scene and fortunately, there are no casualties nor any injuries.

Cllr Sibusiso Mazibuko (ward 1) and Cllr Sydney Sihlalo (ward 12) also responded swiftly and are at the Sindelo home with the family.
