Suspected Cigarette smuggler caught.

Driving with a vehicle full of cigarettes turned out to be a bad choice for a foreign national in eMbalenhle.

An officer was doing an address confirmation in an unrelated case when they notice suspicious behaviour from a Silver Toyota Carolla.

The officer turned back to investigate, and the Toyota sped off. The suspect could not negotiate the turn near the Skosana Butchery and crashed into a minisub station.

A large part of Ext3 in eMbalenhle will be without power because of the damaged mini-sub. The electricians have already started the repair process.

A crowd of foreign nationals gathered around the crashed Toyota and Police vehicle. The driver was taken into custody.

The vehicle was taken to the eMbalenhle police station by Emba Towing where it will be kept as evidence.

The vehicle was searched by the detectives and a large number of illegal cigarettes were confiscated as well as an unknown amount of cash. A further bag of coins was also found hidden behind a Sub speaker in the boot of the Carolla.

The suspect was taken to the charge office to be charged and is expected to appear in court in the next few days.

The illegal cigarette trade is not only damaging the economy but are even more damaging to a smoker’s health than approved cigarettes.

South Africa is the first country in the world to allow an illegal brand to become its top-selling cigarette.

llegal cigarettes today account for approximately 33% of all cigarettes sold in South Africa. Such cigarettes are particularly prominent in the informal trade, where they make up an astounding 42% of the informal market.

What are illegal cigarettes?

Illegal cigarettes are cigarettes on which the correct excise tax has not been paid. These can easily be spotted by their low price. There are 4 recognised categories of illegal tobacco products that can be fund globally, as described by the WTO:

  1. Contraband: Smuggled into markets from either neighbouring markets or transnational routes
  2. Illegal whites: Unbranded, mass produced, unpackaged smuggled loose cigarettes
  3. Local tax evaded: Locally produced cigarettes that enter the market from production leakages in the manufacturing and excise declaration process
  4. Counterfeit: IP infringement of tobacco brands

In any of the definitions list above, the typical marker is a retail price with a selling price that is significantly lower than either the taxes due or standard market prices. Transferring the concept to a local example, a pack of 20 cigarettes selling for below the Minimum Collectible Tax (MCT), as announced by the Minister of Finance each year, should be considered illegal, according to an Eastern Cape High Court judgment in 2015 (National Director of Public Prosecutions versus Adan, 2015).

As of 2019, the minimum collectible tax on a pack of 20 cigarettes is R19.16, making any pack selling for less than this suspect of being illegal.

Many assume that illegal cigarettes are smuggled into the country, or are counterfeit versions of legitimate cigarette brands. While such illegal cigarettes would indeed be illegal, these do not form the bulk of illegal cigarettes sold in South Africa.

Instead, South Africa’s illegal cigarette market is heavily dominated by local, licenced tobacco manufacturers who do not declare all their manufactured product to the South African Revenue Services (SARS). It is now estimated that over 90% of all illegal cigarettes in South Africa are manufactured locally, in factories that are quite visible in some of our biggest metropoles.

The latest Ipsos Tobacco Market Study, commissioned by the Tobacco Institute of Southern Africa (TISA), showed that RG cigarettes are now the top-selling brand in the country. In November 2018, the study revealed that RG brand sells for an average of R10 per pack, well below the MCT of R17.85. RG is manufactured by a SARS registered tobacco manufacturer, with a factory in Johannesburg.

Manufacturers of illegal cigarettes produce and earn profit on vast volumes of cigarettes, while paying SARS only a small portion of the tax owed. These manufacturers are widely known, and are reported to be significant funders of some of South Africa’s largest political parties. This under-declaration of volumes equates to tax evasion, and costs the South African fiscus, a conservative estimate of R8 billion every year.

In addition to depriving the Government of much-needed tax revenue, the illegal tobacco trade harms the social fabric of South Africa in many ways, with government’s Non-Communicable Disease health strategy the most impacted. Other studies done outside of South Africa have found that revenues from illegal trade support further criminal activities such as human trafficking, terrorism activities, and corruption, amongst other various examples of criminal activities linked to illegal trade.

Growth in locally produced illegal cigarettes has significantly eroded the value chain in the legal cigarette market. BAT South Africa’s business has declined by 30% since 2012, forcing us to adjust the size and structure of our business.

This course was facilitated over two days.

Phase 1, day 1 the following subjects were covered: Legislation, duties of the employer, duties of the employee, communication, respect and personal hygiene.

Day 2 they covered, cleaning the bedroom, kitchen, bathroom, living room, doing the laundry and a house cleaning checklist. 

The general feeling after the assessment was that the course gave them a purpose and they felt empowered and are ready to further their studies with Eduvacs.

End Unscrupulous and Unconstitutional municipal services delivery practices in GMM

“End Unscrupulous and Unconstitutional municipal services delivery practices!” This is the call from the newly formed “Govan Mbeki Municipality – Joint Civil Movement” at a recent press conference held in eMbalenhle.

It is clear that residents can no longer tolerate the state of municipal services from Govan Mbeki Municipality. Not only does Bethal and eMzinoni suffer crippling power cuts at the moment, but eMbalenhle are also having serious electricity problems. This is not the only problems facing GMM residents across the municipality but the pollution of rivers and streams due to constant sewer spillages are posing a serious health risk to all residents, it also poses a health risk to people downstream.

Illegal dumping and poor dumping site management are causing serious headaches to the residents so to speak.

Potholes are not filled and the road infrastructure is seriously deteriorating throughout the municipality. Civil rights movements are constantly trying to help with the roads especially, and the GMM Mayor are constantly putting pressure on large organisations such as Sasol to rectify the municipal failures.

The GMM Civil Joint Movement wrote a letter of demand to the Executive Mayor, the Mayoral Committee and the entire Council of GMM demanding that Service delivery be addressed with immediate effect.

1. Start immediate and inclusive works with the larger society in repositioning the municipality so as to achieve its constitutional obligation.

2. Hand over the Municipality to its original owners namely being the society at large in a form of immediate stepping down as Council of Govan Mbeki Local Municipality.

The voices of residents are once again gaining momentum through organisations such as these. Promises were made by the Premier, regarding items such as the removal of the Mayor and the returning of electricity supply to Eskom, in 2018 after a disastrous protest action campaign that ended in the burning of Emba Mall.

The situation throughout the municipality have now deteriorated to a point that is far worse than those that paved the way for the 2018 protest.

The Eskom Debt alone escalated with R1,5 Billion from July 2018 to its current state. Rand water escalated to a point were GMM are now being restricted with their water supply. Fuel is not supplied due to non-payment by GMM resulting in vehicles being grounded, including refuse trucks.

Yellow fleet (construction and refuse vehicles) should have been replaced after 2018 but instead, mainly bakkies were acquired.

DEMAND TO THE END OF UNSCRUPULOUS MUNICIPAL SERVICE DELIVERY TO THE GREATER CITIZENS OF THE GOVAN MBEKI LOCAL MUNICIPALITY

To all respective parties concern subject to the above attention: We the Govan Mbeki – Joint Civil Movement, with this official letter herby demand immediate ending of the unscrupulous and unconstitutional municipal services delivery rendered to us the Govan Mbeki – Joint Civil Movement, together with the greater Citizens of the Govan Mbeki Local Municipality.

Our South African Constitution put it clear that municipalities have the responsibility to make certain that all of its citizens are provided with sustainable municipal services to satisfy their daily needs:

Chapter 7 Local Government, Section 152 and 153 puts clear sets of constitutional obligation of municipalities to abide to:

152. (1) objects of Local Government –

a) Provide democratic and accountable government for local communities by; – Working with Residents, NGO`s and CBO`s to monitor processes as well as to advise the municipality on priorities for service extensions and improvements.

b) Ensuring the provision of services to communities in a sustainable manner that includes; – Water, Sanitation, Electricity, Roads, Storm water drainage, Solid waste disposal & Municipal parks and recreation

c) Promote social and economic development through; – Education, Employment and Business opportunities

d) Promote a safe and healthy environment on; – Land, Air and Water

e) Encourage the involvement of communities and community organisations in matters of local government so to allow; – Transparency and accountability

(2) A municipality must strive, within its financial and administrative capacity, to achieve the objects set out in subsection (1)  

153. Developmental Duties of Municipalities –

a) A Municipality must structure and manage its administration and budgeting and planning processes to give priority to the basic needs of the community and promote social and economic development of the community;

b) Participate in national and provincial development programmes.

POLICE LAUNCH MANHUNT FOR SUSPECTS INVOLVED IN THE MURDER OF A LAW ENFORCEMENT OFFICER INJURING ANOTHER

The police in Mpumalanga have launched an intensive manhunt for suspects who shot and killed a law enforcement officer and wounded another. The incident occurred in the early hours of today, Saturday, 25 July 2020 at Emalahleni.

So far information suggests that a group of about six suspects went to a filling station along the road to Lynville near Emalahleni, where they stormed in and robbed employees of their belongings.

They allegedly placed explosives on the counter and threatened to detonate them should the employees try to alert police.

The suspects’ plan was however interrupted by Municipal Law Enforcement Officers patrolling in the vicinity, who went to the filling station unbeknownst there was a robbery in progress.

This resulted in a crossfire between these members and the suspects which led to Warrant Officer Samuel Nkosi being fatally wounded.

Meanwhile, his 53-year-old colleague sustained gunshot injuries to his right hand.

Police and medical services were called to the scene whereupon Nkosi was certified dead whilst the surviving member was taken to hospital.

In the meantime, the Provincial Commissioner of the South African Police Service in Mpumalanga, Lieutenant General Mondli Zuma has called on the community to assist police with the investigation into this heinous crime.

GAUTENG POLICE ARREST THEIR MPUMALANGA COUNTERPARTS FOUND IN POSSESSION OF DAGGA

Gauteng and Mpumalanga Provincial Commissioners, Lieutenant Generals Elias Mawela and Mondli Zuma, have both welcomed the arrest of two Mpumalanga officers on Friday evening, 24 July 2020 by their Gauteng counterparts in Springs.

Members from Devon in Ekurhuleni District stopped a private vehicle at a static roadblock on the R29.

The team’s suspicion and subsequent search of the vehicle led to the occupants confessing that the dagga they had in their vehicle, had been taken by SAPS members in a marked Mpumalanga (Secunda) SAPS Flying Squad vehicle.

These flying squad members had allegedly also demanded and taken a sum of money.

On realising that the said state vehicle had passed through the roadblock, the members immediately pursued the vehicle and cornered their Mpumalanga counterparts at a road intersection in Springs.

The members were found in possession of dagga and cash and arrested on the spot.

The two suspects are now facing both a criminal charge as well as departmental steps that have been sanctioned as a matter of urgency by Lieutenant General Zuma, the Provincial Commissioner of Mpumalanga.

Reacting to this arrest, Generals Mawela and Zuma commended the Gauteng officers who have demonstrated high discipline by arresting their own and aligned themselves with the SAPS Anti-Corruption Strategy that seeks to root out corruption from within the ranks.

1 POSITIVE CORONAVIRUS CASE AT EMZINONI POLICE STATION

All communities serviced by the Emzinoni Police Station are advised that this police station will be temporarily closed due to a member who tested positive for the coronavirus.

The Community Service Centre will now be operated at Emzinoni Lethithemba Drop-In Centre situated on 9th Street.

Steve Tshwete Municipality employee arrested for 40 counts fraud

Sylvia Nyandeni (43) was arrested by members of the Hawks’ Serious Commercial Crime Investigation Mpumalanga on Wednesday on forty (40) counts of fraud.

It is alleged that in October 2018 Nyandeni an employee of Steve Tshwete Municipality presented herself to the complainants that she had the authority to receive monies for RDP houses.

The supposed houses were to be built at Rockdale, Middelburg and Nyandeni summoned the complainants to pay deposits before they can obtain their houses.

Almost R 700 000 was deposited into Nyandeni’s and her accomplice’s bank accounts, who was unable to present himself in court due to ill health.

Meanwhile, the fraud was reported to the Hawks in 2018 and investigations led to her arrest.

Nyandeni appeared before the Middelburg Magistrate Court on Thursday and she was warned to appear again on 20 August 2020.

The warrant of arrest for the other suspect has been withheld as he was warned to appear with Nyandeni on the same date.

Tonight, as President Ramaphosa addressed the nation, a shred of hope was left in South Africans. The President announced that schools will be closed due to the rise in infections.

He said that: “… Department of Basic Education has met with more than 60 organisations representing parents, school governing bodies, principals, educators, independent schools and civil society organisations. It has also consulted with the Council of Education Ministers, representing the provincial education departments.”

The decision was made in these meetings to ensure the health and well-being of the learners who have returned to school.

Schools will close from 27 July and will re-open on 24 August with the exception of Gr 7 and Gr 12 learners.

The Gr 12 learners and teachers will be returning on 3 August and the Gr 7 learners and teachers will be returning on 10 August.

He continued by saying that the Minister of Basic Education will provide more information on the matter.

The National School Nutrition Programme will continue to operate to ensure the well-being of learners.

The President continued and spoke about the R 500 billion social relief and economic support package.

The R 500 billion has assisted the country in the health response to the coronavirus.

“This includes additional expenditure on personal protective equipment, community screening, increased testing capacity, additional beds in field hospitals, ventilators, medicine and staffing.”

“Over 4.4 million people have now received the special COVID-19 grant, which assists those who are unemployed and do not receive other forms of support. So far, an amount of R 2.2 billion has been paid out to these recipients.”

Furthermore, the fund has been used to support small businesses in the form of loans, grants and business restructuring.

The UIF’s special COVID-19 assistance has paid out R 34 billion, helping over seven-and-a-half million workers.

“The rules of the scheme have been adjusted to expand the eligibility criteria and increase uptake, making it easier for businesses to access finance during this period,” said the President.

He continued: “Over R 70 billion in tax relief has also been provided to companies.”

During this time, corruption allegations have been flying around. The President spoke about the preventative measure that have been put in place to ensure that corruption comes to an end.

The President signed a proclamation authorising the Special Investigating Unit to investigate any such allegations and to ensure that he receives reports every 6 weeks.

In addition to all these measures we have established a collaborative and coordinating centre to strengthen the collective efforts among law enforcement agencies so as to prevent, detect, investigate and prosecute COVID-related corruption.

This centre brings together nine state institutions.

These are the Financial Intelligence Centre, the Independent Police Investigative Directorate, the National Prosecuting Authority, the Hawks, Crime Intelligence and the SAPS Detective Service, the South African Revenue Service, the Special Investigating Unit and the State Security Agency.”

This was decided as there are at least 36 cases open and being investigated at the moment.

Vele groot lesse oor die lewe word nie op universiteite of kolleges gedoseer nie.  Kennis oor die lewe wat werklik saak maak, word nie gemeet aan ‘n sertifikaat wat teen jou muur hang, of die titels wat jy voor jou naam kan skryf nie. Mens noem dit wysheid. Dit het ek, snaaks genoeg, onder andere geleer by ‘n vrou in die Noord-Kaap wat glad nie kon lees of skryf nie.

Maar sy het ‘n vlymskerp verstand gehad, en kon soms moeilike bestaansinsig netjies toedraai in haar Noord-Kaapse Afrikaans. Op die vooraand van haar afsterwe het sy my uit die Kimberley staathospitaal gebel om my te laat weet dat sy nie na ons huis daar op die Bo-Karoodorp kan omsien nie. Op my vraag wat fout is, het sy geantwoord: “Die dogter het gesê my wit bloed eet my rooi bloed.” Onmiddelik het ek geweet. “Ag, ou Milo, dis nou vir jou bitter sleg, jong” was my antwoord. “Ek hoop jy word gou gesond.” Met ‘n knop in my keel, wetende dat dit nie gaan gebeur nie.

Haar antwoord het my lewenskennis en lewenservaringshorisonne verruim, soos die filosoof Hans-Georg Gadamer geskryf het in sy werke Warheit und Methode en The relevance of the beautiful.  Dit het my, wat jare al met filosofie en teologie geworstel het, eensklaps ‘n nuwe visie gegee, dalk die hermeneutiese sleutel tot die sin van die lewe waarna ek altyd worstelend gesoek het.  Sy het gesê: “Mens leef maar die lewe soos hy kom.”  The relevance of the beautiful, inderdaad.

Ek het onlangs ook ‘n ander kosbare lewensles onthou. Tannie Lena, ‘n dierbare tannie ook van die Noord Kaap, en haar kleindogter was op die grondpad op pad, toe haar motor skielik aan die brand slaan so kilometer of wat voor hulle plaashek. Die tannie het maar moeilik geloop, maar sy en haar kleindogter het vinnig uitgeklim, en handsak oor die arm het sy begin stap na die plaas toe.

Haar kleindogter wat toe nog ‘n jong meisie was, was uiteraard ontsteld, en het omgekyk na die bruin Audi wat in ligte laaie staan. Tannie Lena se woorde was: “Moenie terugkyk nie, my kind, moet nooit terugkyk nie. Kom ons stap aan.” Komende van ‘n deurwinterde, gelowige en sterk vrou wat haar seun aan die dood moes afstaan toe hy net klaar was met skool.

Dis waaraan ek gedink onlangs het toe my geheue heeltyd teruggefoeter het na die verlede toe, na privaathospitale in die ooste van Pretoria en die hospitaal in Trichardt wat soos vyfsterhotelle lyk. Voorkeuraandag, die beste personeel, effektief, voorkomend. Ek moes myself dwing om my Noord Kaapse lewenslesse toe te pas. Moet nooit terugkyk nie.  Leef die lewe soos hy kom.

Ek moes daardie oggend 07:30 by staatskliniek wees vir bloed trek. Dis was 10:21, en ek het nog in ‘n ry in die straat gestaan en wag om die heiligdom van die wagkamer te betree. Lepeltjie-staan. Soos Johannes Kerkorrel sing in Die ou-ou lied van Afrika: “mond-aan-mond, en lyf-aan-lyf.” Natuurlik dink mens dan terug aan toentertyd, hoe dit was.  Maar op daardie oomblik het ek gevoel soos Piet Retief by Ungungundlovu.  Geen sosiale distansiëring.  Hier en daar het een ‘n masker op, baie van dit onder hulle kenne. Dit het gelyk soos die klawers van ‘n vendusieklavier.

Gelukkig het my mede-rystaners vermaak verskaf, alhoewel daar nie vooraf ingeoefen is nie. Ons het spoedig ‘n esprit-de-corps ontwikkel, a feeling of pride and mutual loyalty shared by the members of a group, waar ek heelwat kennis opgedoen het. Nie noodwendig filosofies van aard, of in dieselfde kategorie as diè van die Noord Kaap waarvan ek vertel het nie, maar ek het gehoor waar mens “entjies” kan koop teen die beste pryse (alhoewel ek nie rook nie), watter teken jy by die spaza-winkel moet gee as jy ‘n allesoorheersende dors beleef vir ‘n papsak, en dergelike eksistensiële waarhede.

Die esprit-de-corps het duidelik geword toe een impi wou indruk voor in die tou, en ‘n klein, maer vroutjie hom geklap het dat sy liggaamsvloeistowwe soos ‘n balaklava om sy kop sit. Jy sien net hakke en elmboë soos wat sy Coronavirus halsoorkop en doodsbeangsd, ore in die nek, vlug uit sy longslyme en bloedplaatjies, die wydtes in.

Gelukkig kan mens nog lag, besef ek op daardie oomblik. Moenie terugkyk nie, moet nooit terugkyk nie.  Kyk nou, hièr.  Dit is hoe dit is. Met of sonder Steve Hofmeyr. Op daardie oomblik het daar iets in my gemoed losgekom, en ek het die situasie begin waardeer.  Die woord “geniet” sou ‘n ongelukkige woordkeuse wees. Ek was vieserig, om dit eufemisties te stel.

Maar, hoe meer de m@#r in of bang ek raak, hoe snaakser raak ek. Ek was skreeusnaaks net voor my hartomleiding. Die kardioloog het so gelag hy het eers ‘n vasektomie, en toe ‘n kastrasie gedoen, voordat hy my blindederm uitgehaal en my ‘n facelift en borsverkleining gegee het. Tot die teatersuster vir hom gesê het hy moet sommer my hart ook check.  Jong, ons het lekker gelag!

Na diè ervaring het ek anders begin kyk na die wêreld. Oral word gesê dat ons nooit weer sal terugkeer na hoe dit was voor Corona nie.  Mag wees. Of dalk nie. Maar om heeltyd te tob oor wat was, veroorsaak dat jy dit wat ís, miskyk.  Ek kon óf dikbek gewees het oor die toustanery by die kliniek en heeltyd gemor het oor hoe goed my lewe tot dusver was, of ek kon dit rondom my raaksien en met humor, takt en geduld takseer.  Laasgenoemde het summier my gemoed verlig. Ek kon inpas in die moeilike van nóu, omdat ek die goeie van gister onthou.
