Suspects in court for mine fraud of over R1,1m

ADDITIONAL SUSPECTS IN COURT FOR BARBERTON MINE FRAUD SURPASSING R1.1MILLION  

MPUMALANGA – Bhekinkosi Fana Madonsela (30), a former Administration Clerk at Barberton mine, appeared before the Barberton Magistrate Court on Tuesday 11 May 2021. He was arrested by members of the Hawks Serious Commercial Crime Investigation team with a warrant of arrest for Fraud, Theft and Money Laundering on Tuesday 11 May 2021.

Madonselas’ arrest followed his alleged link to a share of R300 000.00 received from his accomplices. He and Precious Nontobeko Magongo (36) were former Barberton mine employees, working as Clerk  Administrators. Magongo was the first suspect to be arrested on 01 March 2021 for receiving undue payment of almost half a million Rand (R497 885.00) fraudulently.

These undue payments were reportedly carried out by the main suspect, Simphiwe Sangwenyi (38), also a mine employee working as a financial administrator. Sangweni is still being sought by the Hawks and a warrant of arrest was issued by Court on the 5 November 2020 against him.

The trio colluded and prejudice the Barberton mine a total loss of R ‪1 156 700.00‬ through misrepresentation. Sangweni transferred money from Barberton mine account to his personal account and further distributed it to different accounts of  Magongo and Madonsela. An internal investigation was conducted and the accused disappeared.

The case against Madonsela was postponed to 12 July 2021 and he was released on R5 000.00 bail. He is expected to appear along with his co-accused Magongo.

Sasol donated diving equipment to Delta 1

Sasol handed diving equipment to Delta 1 Rescue Diving at a function at Sasol Club.

Rethabile Ndjibu, Manager: Corporate Communication, Events and Branding at Sasol, said that growing up in a township, she knew that a lot of children don’t really know how to swim but they think that they do. “Children would then go and swim in an unauthorised area,” said Rethabile, “and we would then be told at the end of the day that someone is missing only to find the body later on.”

She said that the first time that she saw a diver was at such an incident. “I realised how important such a job is.”

Rethabile also thanked Delta 1 for the opportunity to work together.

Delta 1 Rescue Diving Team

Jaco van der Merwe, marketing manager for Delta 1, thanked Sasol for the donation and gave an overview of statistics in the province.  Delta 1 had 316 call-outs over the past 3 years and there were 225 drowning incidents in the same period. 268 bodies were recovered over the last three years.

SUSPECT TO APPEAR IN COURT FOR POSSESSION OF DRUGS

NELSPRUIT – A 63-year-old Mozambican national is expected to appear before the Komatipoort Magistrate’s Court tomorrow, 12 May 2021, for possession of drugs. He was arrested this morning at the Lebombo Border Post.

According to information received, the suspect was travelling from Mozambique to South Africa when his vehicle was stopped for processing, by members from the South African Police Service and South African Revenue Service Customs during a joint routine operation.

The two formations then thoroughly searched the vehicle, a white double cab Toyota bakkie and found about 136 kilograms of suspected heroin as well as 19 kilograms of suspected crystal meth worth a combined value of about R32 million. The drugs were found stashed underneath charcoal which was loaded at the back of the bakkie.

The Senior Manager of SARS Customs in the province, Memory Ndou praised the collaboration. “This success was achieved through a joint intervention between SAPS and SARS. Continuously collaborating as law enforcement agencies ensures the execution of the mandate as well as protects the economy and the people.

The Acting Provincial Commissioner of the South African Police Service in Mpumalanga, Major General Thulani Phahla, applauded the collaborative efforts of the two formations. “We appreciate the working relations between SAPS and SARS at the border as it always yields positive results, ” lamented General Phahla.

MPUMALANGA – A 25 years old suspect is expected to appear before the Hendrina Periodical Court on Wednesday, 12 May 2021. This follows his arrest by members of the Hawks Serious Commercial Crime Investigation in Secunda on Monday 10 May 2021 for fraud.

It is alleged that in October 2020, the suspect defrauded the complainant R350 000.00 by promising her that she will get a tender of delivering food at Witbank area for municipality. The suspect demanded R350 000 from the  victim which was paid into a number of bank accounts. After the victim paid the money the suspect disappeared.

The matter was reported to the Hawks in October 2020 and investigation led to the arrest of the suspect at Kabokweni on Monday.

Police Constable to appear on charges of robbery

POLICE CONSTABLE DUE TO APPEAR BEFORE COURT FOR ARMED ROBBERIES

NELSPRUIT – Management of police in Mpumalanga has commended members on their well-knitted investigation, leading to the pinning down of a 40-year-old police constable on Monday 10 May 2021, at Volksrust. The suspect is due to appear before the Volksrust Magistrate’s Court today.

Reports indicate that the area of Volksrust abruptly experienced an uptrend of business robberies where cases were registered and subsequently investigated. The latest robbery occurred on 10 April 2021, where a group of armed suspects violently stormed a certain clothing shop and held the staff hostage at gunpoint. They (suspects) then instructed victims to stay in the storeroom whilst they helped themselves with various items, including cell phones and some clothing items to an estimated value of about R150 000.

The incident was eventually reported to police where a vigorous manhunt was launched. Police followed all possible leads on the whereabouts of the villains and managed to arrest six of them, found in possession of an unlawful firearm as well as ammunition. Four of the said suspects reportedly escaped from lawful custody at Volksrust Magistrate’s Court as they were scheduled to make their second court appearance on 19 April 2021. However Welcome Mncube (56) was rearrested and the rest, 34 year Jima Dube, Sandile Gasa, aged 42 as well as 28 years Emmanuel Sibanda are still on their undue freedom.

During the tour of the investigation, police discovered that the arrested member was also found to be allegedly involved in some of the robberies. He was then sought and apprehended hence his court appearance. An internal investigation against him to determine his fitness to remain as a police officer is underway.

Open fires and firebreaks prohibited 2021

That no person shall from Thursday, 06 May 2021 make an open fire in open air, allow it to continue to burn or add additional fuel to it

It is the time of year when the grass is drying out and a lot of fires are started. These fires sometimes spread to the surrounding veld resulting in loss of grazing, crops and even livestock.

There are strict laws regulating to fires in the open and fires on farms etc. The Highveld East Fire Protection Association (HEFPA) issued a prohibition notice regarding fires.

Here is the full notice:

BURNING PROHIBITION NOTICE 2021

IN TERMS OF CHAPTER 2 OF THE NATIONAL VELD AND FOREST FIRE ACT 101 OF 1998

The Highveld East Fire Protection Association (HEFPA), duly registered as the fire protection association in the Govan Mbeki Municipal area, hereby declares a period of extraordinary fire hazard within its boundaries and therefore directs:

  1. That no person shall from Thursday, 06 May 2021 make an open fire in the open air, allow it to continue to burn or add additional fuel thereto, other than –
    • Fires made within a demarcated picnic or camping area or caravan park, or holiday resorts, but only at places within such an area which have been specifically prepared and maintained for that purpose; provided that such fires are properly extinguished with water and/ or sand;
    • Fires for the preparation of food in residential areas;
    • Fires made on residential and industrial stands in proclaimed townships;
    • Fires made for initiation school purposes, but only at places that have been specifically prepared and maintained for that purposes to prevent fires from spreading.
  2. That no person shall from 06 May 2021 destroy by burning and slashing any timber plantation or self-sawn exotic trees or alien invasive plants.

Burning of Firebreaks

That no person shall from 06 May 2021 destroy by burning residue, cultivated crop fields or veld, clear or maintain a firebreak by burning;

Provided that such fires may be made only on days when the average Fire Danger Index at 14:00 for the fire region is less than 60 and predicted wind below 10km/h for the period after 14:00.

A burning permit must be obtained from HEFPA.

Block burning

Conservation of Agricultural Resources Act (CARA) (Act 43 of 1983)

Burning of Grassveld and planted residue (Block Burning) can be done under the following conditions:

  • Block burn permits shall be made available from 15 July 2021
    • Double width fire belt (20 metres or more) must be prepared around the planned block burn area before 7 June 2021
    • The permit must be obtained from HEFPA
    • Acceptable fire fighting equipment must be present as per the minimum standards and requirements of HEFPA
    • Maximum FDI prediction of 59 or less must be forecast for the day when the burn is planned
    • THE FDI prediction for the following day at 14:00 may not exceed 55.

Rules and Regulations

All permitted fires must comply to the HEFPA Rules and Regulations Revision 3.

It is further recommended that grazing veld should only be burnt on rotation every 3 years.
