MM placed on suspension by ANC majority

0

MM placed on suspension by ANC majority during a controversial council meeting.

“It doesn’t matter what the opposition says, we will push it through!” The words of MMC Ethel Nkosi still ring in the ears of the opposition as the ANC pushes through their agenda of removing the Municipal Manager. These words were uttered by the MMC in 2018 when opposition parties opposed the budget.

The last extraordinary council meeting was no different. Opposition parties vehemently opposed the suspension of the Municipal Manager, proposing that at the very least the Mayor and CFO should also be suspended and investigated.

The council meeting was scheduled for Wednesday. Only two items were tabled to the council. The first one was the Human Rights Report regarding the sewer spillages in Govan Mbeki Municipality (GMM). The second was the proposed disciplinary action against the Municipal Manager. The actual item was withheld until the last minute in contravention of the Councill Standing Orders.

Opposition parties called the item a witch hunt to divert the attention away from Ngxonono and her mayoral council. The DA said that they will not be part of the meeting and withdrew from the virtual meeting. The EFF also withdrew from the meeting and the FF+ followed suit. The ANC councillors that were left did not form a quorum and the meeting had to be reconvened on Thursday.

The item was presented again and the ANC used their majority to push the item through. Opposition parties again did not attend.

The Director of Community Services, Lizzy Shabalala, was appointed as acting Municipal Manager.

The Municipal Manager, Felani Mndebele and Director for Community Services, Ms Elizabeth Kotishana Tshabalala during the signing of her Performance agreement. She was appointed Director for Community Services during March 2020

During the presentation of the item, the Mayor, Cllr Thandiwe Ngxonono, accused the Municipal Manager, Felani Mndebele of the late submission of the Annual Financial Statements. Her letter to the MM stated: ”You failed to submit the Annual Financial Statements which has led to the municipality not getting the equitable share, resulting in the non-payment of many creditors, therefore, entering the municipality deeper into debts as the municipality is being charged more interest on debtors.”

This is contrary to previous council meetings where the late submission of the Annual Financial Statements was condoned by the council.

Ngxonono claimed that the MM and his officials cost the municipality several millions of Rands but the MM denied this in his reply.

Ngxonono levelled several accusations against Mndebele, all of which the MM repudiated.

In his response to the allegations by the Ngxonono, Mndebele stated that “there is massive political interference meted out by the Executive Mayor since my appointment on the following issues, namely: recruitment/appointment of staff, the appointment of Service Providers to do business with Council and Payment of Service Providers.”

Mndebele made it clear that more information will be revealed during his disciplinary tribunal.

Mndebele stated that his day to day running of the municipality was made virtually impossible by the interference of the Mayor. She insisted on consulting on all decisions taken by Mndebele.

Opposition leader Democratic Alliance Councillor Ciska Jordaan said in her statement to the council: ”The DA is shocked, but not surprised with the response that was submitted by the Municipal Manager. What has been clarified, is what we have suspected all along and categorically stated in the last council meeting and we will repeat again: the Executive Mayor’s attempt to suspend the MM wreaks of political interference and blame-shifting.

This is confirmed by the claim that the Executive Mayor neglects to do performance assessments of the MM but now wants to recommend for his suspension saying that he is not performing.”

“It should be a concerning eye-opener, that the council continuously condones incompetency as in the case of the late submission of the AFS which was condoned by the council twice. This then becomes our burden – it is caused by incessant majority voting while councillors are often clearly not even aware of what it is they are voting for but simply siding with the ruling party despite the advice of the Opposition – and cannot be blamed on the administration.”

She continued: “The MM appallingly mentions how he attempted twice to discipline an official for non-performance, and that this is well known and have been found by the Office of the Auditor-General, Provincial Treasury and the Executive Mayor who promised to consult the MEC for CoGTA and the ANC so as to be able to advise the MM as if it is her decision.”

“Furthermore, the DA is deeply disturbed by the allegations that there is massive political interference meted by the Executive Mayor in a number of matters and that the MM was expected to consult with the Executive Mayor on all decisions to be taken.”

Ciska pointed out the following to the Mayor and council: “These, are allegations of high-level corruption and a criminal offence that is liable to a fine or imprisonment according to section 119 of the Municipal Systems Act and should be investigated.”

“Any councillor who supports these recommendations of the Executive Mayor, after having read the allegations that are made by the MM and taking into cognisance the words of the President that I have quoted earlier, is clearly not voting with his or her conscience and honouring the oath that they have taken to serve.”

Before withdrawing from council Ciska ended her statement with the following: “I think we have made it unconditionally clear Honourable Speaker, that as the Democratic Alliance we reject this item in its totality, we continue to call for the Executive Mayor to be held accountable for the mess this municipality is in and since the ANC is clearly going to steamroll this witch hunt, out of protest, the DA, therefore, withdraws from this meeting, in the effort of leaving the council without a quorum.”

The mayor also has duties in accordance with the Municipal Finance Management Act (MFMA). Several areas have prescribed duties in the act but the area that needs to be highlighted is contained in Chapter 7. (Taken directly from the act)

RESPONSIBILITIES OF MAYORS

General responsibilities

52. The mayor of a municipality-

(a) must provide general political guidance over the fiscal and financial affairs of the municipality:

(b) in providing such general political guidance, may monitor and, to the extent provided in this Act. oversee the exercise of responsibilities assigned in terms of this Act to the accounting officer and the chief financial officer, but may not interfere in the exercise of those responsibilities;

(c) must take all reasonable steps to ensure that the municipality performs its constitutional and statutory functions within the limits of the municipality’s approved budget:

(d) must, within 30 days of the end of each quarter, submit a report to the council on the implementation of the budget and the financial state of affairs of the municipality: and

(e) must exercise the other powers and perform the other duties assigned to the mayor in terms of this Act or delegated by the council to the mayor.

Freedom Front Plus Councillor Aranda Nel-Buitendag said in a statement to The Bulletin: “The FF plus feel the suspension of the Municipal Manager is unacceptable. The allegation that was made by the Executive Mayor of the MM is absurd.”

“In our previous council meeting, there was documentation to follow the right process to suspend the MM. The FF Plus voted against the suspension and so did other opposition parties, however, the ANC overruled us as opposition parties with their majority.”

“The FF Plus feels that the CFO of GMM is responsible for the late submission of the Annual Financial Statements by staling the submission, ensuring that the financial reports did not reach AG in time.” said Aranda.

“The best came to light in the MM‘s report where he implicated the Executive Mayor in wrongdoing by interfering in the MM’s job so that he could not perform his duties as a MM properly.”

“This shows that the EM failed, in her position as mayor, to do the oversight and not interfere in officials work,” concluded Aranda, “What is the EM hiding in this process? Is she removing the MM so that they cannot point a finger at her at all?”

The Bulletin can only conclude that whilst the politicians battle it out in Council Chambers, residents will still have to endure load-shedding, sewage spillages, poor refuse removal and other service delivery failures.

Move One Million demonstration on Saturday, 5 September

Below is a press release from the Move One Million National Spokesperson, Joanita Van Wyk:

Staunch call for peaceful demonstrations

Move One Million organisers call upon all South Africans across the country to adhere to the government’s message about Heritage Month to foster greater social cohesion, nation building and a shared national identity as they take to the streets this weekend.

The grassroots movement Move One Million has united over half a million citizens via social media over the past 6 weeks. They strongly urge all those in support of the movement to keep in mind the reason they are taking part in this mass demonstration on Saturday 5 September 2020. The movement emphasizes that the values of love, unity, respect and kindness should be adopted by every ‘mover’ intending on taking to the streets.

Jarette Petzer, founder of Move One Million stated: “We call upon all citizens supporting Move One Million to show the utmost respect towards their fellow citizens including authorities such as SAPS. This is set to be the biggest, most unifying movement in our 26 years of democracy. We strongly encourage everyone to hold the vision of a united, peaceful and prosperous South Africa at the forefront of their minds on Saturday.”

In the interest of public safety and based on the response from the police last week, organisers call upon all participants to refrain from approaching all parliamentary buildings, Houses of Parliament in Cape Town in particular. Those in Cape Town are invited to join in activities at Grand Parade.

The movement strongly condemns any acts of looting and burning or destruction of property including all private, public and government property. Citizens are reminded not to mount, deface, drape items on, or destroy any monument or other property.

Everyone is asked to abide by the laws regarding the respectful display of the South African flag and that it is illegal to display the old Apartheid flag.

All participants are to refrain from any act of violence. They also ask participants to keep in mind the relevant regulations of the Disaster Management Act including social distancing to reduce the spread of the virus.

Petzer went on to say: “We understand everyone’s frustrations and emotions are high but let us not spoil the start of something that is so much bigger than each of us as individuals. Our movement belongs to all of us. We welcome citizens from all races, orientation, religious backgrounds and all walks of life. We ask people to adopt our values of love, unity, caring and kindness as ways to channel their frustrations in a positive and productive way.”

Where possible, organisers urge others to take part by means of vehicle convoy. Those creating awareness on street corners are reminded to please adhere to all road safety regulations which includes not walking on the roads itself except at pedestrian crossings when it is safe to do so and not distracting drivers whilst driving or blocking the flow of traffic for everyone’s safety.

So is die Lewe: Knettervuur

0

Titel is Knettervuur.

Doris Brasch: Die Lap-pop

So vat ons die N1 verby Worcester, noord. In Kaapse definisie was ons nou summier in Johannesburg.

“Dis die beste bakkie in Suid Afrika, my Lanie,” sê hy.

LEES OOK: So is die Lewe: Afrika se Hartklop

“Hemingway and I felt deeply in love with the land”, het Peter Sarstead oor Afrika gesing.

God is net ‘n hartklop vêr. Die ewigheid kom lê volledig in jou. Eensklaps. Onteenseglik. Jy voel vuilgoedsakloos.

1 SECURITY GUARD APPEARS FOR VARIOUS CHARGES

A 28-year-old security guard, Lucky Vala, appeared at the Standerton Magistrate’s Court today, on various charges including, fraud, theft as well as impersonating a senior prosecutor.

The suspect was arrested yesterday, 01 September 2020, at Standerton during a police operation.

According to information received, Vala, who is stationed at Standerton Magistrate’s Court, is accused of soliciting bribes under false pretence from unsuspecting members of the public to reduce their traffic fines.

He would apparently lure the public in by pretending he is a senior prosecutor, take their money, then go to a private office to reduce the fines illegally.

His cover was blown when several complaints were made from people who had not received their receipts as proof of payment.

The matter was reported to the police, who in turn initiated an operation into the matter and arrested the suspect.

During the arrest, Vala was found in possession of traffic fines, date stamps as well as reduction affidavits.

Sasol hands over 80 000 litres of sanitiser to DBE to help curb spread of COVID-19 in schools

Sasol handed over 80 000 litres of alcohol-based sanitiser to the Department of Basic Education (DBE) yesterday in support of its efforts to help curb the spread of COVID-19 in schools as the country gears to welcome the last intake of learners today.

Sasol Secunda Plant

The sanitiser will be distributed to rural and disadvantaged schools in mostly Limpopo, KwaZulu-Natal, Free State and Eastern Cape provinces which have been identified by Government.

“This donation by Sasol will go a long way in enabling us to maintain the balance between learning and safety,” said Minister of Education, Angie Motshekga.

“When we opened schools with our MECs, we said safety first and for us this donation deals with what we said was a priority. It is safety first and then everything else. So, for us, this donation is highly valued. It is at the heart of what can keep us in or out of schools.”

Since the declaration of COVID-19 as a pandemic in March, Sasol has pulled all stops to support the DBE’s efforts to ensure that learning continues during the lockdown period.

The Sasol Foundation partnered with DBE in March and Africa Teen Geeks on the STEM Lockdown Digital School initiative to provide free online classes.

More than 250 000 Grade R to 12 learners accessed these online lessons.

With schools now re-opened, Sasol wants to support the Department’s endeavours to ensure the health and safety of learners.

“As a patriotic and proudly South African company, we recognise that we have a duty to step up and partner with Government to meet the needs of our communities,” said Charlotte Mokoena, Executive Vice President: Human Resources and Corporate Affairs.

“We are also aware and appreciative of the challenges placed by the COVID-19 pandemic on the education sector, which have ranged from the loss in academic time, vandalism of infrastructure to health and safety concerns for learners and staff at schools. We are committed to helping where we can and how we can.”

The donation of sanitisers is the second one Sasol is making since the re-opening of schools.

After developing our own Sasol-blend of alcohol-based sanitiser that is in line with World Health Organisation’s requirements, Sasol in May distributed close to 100 000 litres of alcohol-based sanitiser to schools and early childhood development centres in its host provinces of Mpumalanga and the Free State, as well as to those along its pipeline that stretches from Komatipoort to Carolina.

It also donated to schools and ECD centres in KwaZulu-Natal along Newcastle, Mandeni, Mhlathuze and eThekwini.

“We understand that a meaningful and impactful response is only possible through collaboration. No single entity has the capacity to do it alone,” said Mokoena.

The South African Police Service management wants to reassure firearm licence applicants that the CFR is attending to licencing backlogs which resulted from the Covid-19 pandemic.

Like most businesses in the country, the CFR is also suffering a setback as a result of the virus which has hampered its performance on delivering on the agreed 90-day turn-around time for licence applications.

READ ALSO: Double farm murder shock!

Compounding this is the influx of reapplications of firearm licences made during the previous firearm amnesty period as well as the current one which are over and above the new applications.

Since the start of Alert Level 2 of the Lockdown, the CFR has put mechanisms in place which could not be done during the previous three Alert Levels, to alleviate the resultant backlog.

Applicants are urged to be patient as the SAPS is reviewing a turnaround time to finalise applications from 90 to 120 working days.

In the meantime, the working hours of employees at the CFR is also being increased to ensure effective and efficient service delivery in this regard.

The management of the CFR, with the full support of the Divisional Commissioner of Visible Policing, Lieutenant General Moeketsi Sempe, is continuously reviewing measures that can be put in place to mitigate the delays in processing firearm licence applications.

Hierdie is ‘n baie gesogde prys.

LEES OOK: Double farm murder shock!

Johan, geniet jou aftrede.

Double farm murder shock!

Glen Rafferty and his wife, Vida Homann Rafferty were brutally murdered on their farm in Normandien, Kwazulu-Natal.

Glen and Vida Rafferty

The double murder took place on 29 August at 22H00. It appeared that they were attacked when they arrived home from visiting friends in Newcastle.

Both were shot numerous times by an unknown number of attackers. One of their dogs were also shot in the attack.

It appeared that the attackers gained entry through the back door and waited for the couple to return, shooting and killing them as they did so.

The bodies of the couple were discovered when a routine farm patrol patrolled the farm at 05H25 on Sunday morning.

Both were lying in front of the front door of the farmhouse.

It is not clear what valuables were taken but the house was ransacked. The only item that seems to be taken appears to be a DVR.

This attack raises questions as to the motive of these type of attacks.

The attackers fled in the couple’s vehicle that was later recovered near Ladysmith.
